1. Acceptance of Terms

By accessing and using Makeable ("the Service"), you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Makeable is an AI-powered image generation platform that allows users to transform images using pre-defined prompts. The Service uses advanced AI models to process your images and generate new variations based on creative prompts.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

3. User Accounts

To access certain features of the Service, you must create an account using Google OAuth. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Credits and Payments

Free Credits: New users receive 3 free credits upon account creation.

Subscription: You may subscribe to our monthly plan for $9/month, which provides 50 credits per month. Credits reset at the beginning of each billing cycle and do not roll over.

Credit Usage: Each image generation costs 2 credits. Credits are deducted when generation begins and will be refunded if generation fails due to system errors.

Payment Processing: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. No refunds will be provided for partial months.

5. Content and Intellectual Property

Your Content: You retain all rights to the images you upload to the Service. By uploading content, you grant us a temporary license to process your images for the sole purpose of generating outputs.

Generated Content: You own the images generated by the Service. However, due to the nature of AI generation, we cannot guarantee uniqueness of outputs.

Storage: We do not permanently store your uploaded images or generated outputs. All processing is done in memory and images are immediately discarded after generation.

Restrictions: You agree not to use the Service to create, upload, or generate content that:

• Is illegal, harmful, threatening, abusive, or offensive
• Infringes on intellectual property rights
• Contains malware or harmful code
• Violates any applicable laws or regulations
• Impersonates any person or entity
• Contains personal information of others without consent

6. Acceptable Use

You agree not to:

• Attempt to reverse engineer or exploit the Service
• Use automated tools to access the Service without permission
• Interfere with or disrupt the Service or servers
• Access or use another user's account
• Resell or redistribute the Service
• Use the Service for commercial purposes without authorization

7. Privacy and Data

Your privacy is important to us. We collect and use your data as follows:

• Account information (name, email) via Google OAuth
• Usage data (generation history, credits spent)
• Payment information (processed by Stripe, not stored by us)

We do not sell your personal information to third parties. Your images are processed in memory and not permanently stored.

8. Disclaimers and Limitations

AS-IS Service: The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Availability: We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

AI Limitations: AI-generated content may contain errors, artifacts, or unexpected results. We are not responsible for the quality or accuracy of generated outputs.

Limitation of Liability: To the fullest extent permitted by law, Makeable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Third-Party Services

The Service integrates with third-party providers:

• Google OAuth: For authentication
• Stripe: For payment processing
• Google Vertex AI: For image generation

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms of Service
• Is harmful to other users or the Service
• Exposes us or others to legal liability

Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through the dashboard.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Makeable operates, without regard to its conflict of law provisions.
